										<content:encoded><![CDATA[<p><strong>En ny studie av forskare vid SEI och Stockholms universitet visar att gruvbolags miljökonsekvensbeskrivningar vid exploatering av mark tar otillräcklig hänsyn till kumulativa effekter på samebyar och deras renskötsel. Detta trots att Miljöbalken och EU-direktiv kräver att bolagen ska redogöra för hur gruvbrytningens effekter påverkar samebyarna.</strong></p>
<p>Studien har publicerats i The Extractive Industries and Society och omfattar 56 ansökningar för gruvprojekt inom renskötselområdet i Norrbotten, Västerbotten, Västernorrland och Jämtland under perioden 1998 fram till 2016. Dessa ansökningar för gruvprojekt kallas bearbetningskoncessioner och omfattas av minerallagen. I ansökan ingår en miljökonsekvensbeskrivning, vilken granskas av myndigheter.</p>
<p>Resultaten från studien visar att bolagens miljökonsekvensbeskrivningar misslyckas med att beskriva den totala, samlade påverkan (kumulativa effekter) av exploatering för samebyar och deras renskötsel. Gruvbolagens miljökonsekvensbeskrivningar missar framför allt att ta hänsyn till:</p>
<ul>
<li>sociala och kulturella effekter för renskötsel och samebyar</li>
<li>senaste forskningsresultat, exempelvis om störningszoners betydelse för  renskötseln</li>
<li>potentiella konsekvenser av samspel mellan gruvprojekt och andra exploateringar såsom vindkraft och vattenkraft.</li>
</ul>
<p>Studien granskade också om de gruvbolag som frivilligt åtagit sig att göra mer än vad lagen kräver, exempelvis genom samråd med samebyar eller genom särskilda rennäringsanalyser, lyckats ta fram bättre beskrivningar av kumulativa effekter än de som inte i samma grad kommunicerat med samebyarna. Men studien visar att även de bolag som frivilligt gör mer än vad lagen kräver har svårt att tydliggöra de kumulativa effekterna.</p>
<p>– Det har i Sverige hittills funnits en tilltro från regeringen att gruvbranschen själv kan ansvara för att adekvat kvalité levereras i deras miljökonsekvensbeskrivningar. Men detta antagande stämmer alltså inte enligt vår vetenskapliga studie, säger Rasmus Kløcker Larsen, forskare vid Stockholm Environment Institute.</p>
FN, Sverige och samiska rättigheter
<p>Internationellt finns allt större förväntningar att berörda urfolkssamhällen ges ett betydande inflytande i beslut som rör deras marker. Detta gäller också när miljöeffekter av exploateringar ska beskrivas. Denna fråga aktualiserades nyligen när FN:s rasdiskrimineringskommitté återigen gav stark kritik av svenska regeringens oförmåga att leverera konkreta resultat i erkännandet av samiska rättigheter. Denna vetenskapliga studie bekräftar detta budskap från FN och visar hur viktigt det är att samiska rättigheter integreras i beslutsprocesser som miljökonsekvensbedömningar.</p>
<p>– Ett rättvisande bild av kumulativa effekter på renskötseln kan endast ges av samebyarna själva och då måste deras rätt att ha inflytande i hela processen också respekteras, säger Carl Österlin, doktorand vid Stockholms universitet.</p>
<p>Regeringen har från 1 januari i år lanserat ett reviderat kapitel i Miljöbalken med en uppdaterat process för miljökonsekvensbeskrivningar (kap 6). Naturvårdsverket arbetar med att ta fram ny vägledning för verksamhetsutövare som vill söka tillstånd. Den nya Miljöbalken inkluderar ett förtydligande att kumulativa effekter ska beaktas, men har inte ändrat det faktum att ansvaret läggs på de tillståndssökande bolagen att självmant välja hur man vill gå tillväga. Många problem kvarstår därför även med den nya Miljöbalken. Även om rättighetsfrågorna i grunden kräver politiska lösningar finns dock också möjligheter för vissa förbättringar redan i när framtid.</p>
<p>– En konkret möjlighet vore om Naturvårdsverket följer upp med tydligare riktlinjer. Främst behövs en specifik vägledning för hur exploatörer och myndigheter kan ge samebyar bättre möjligheter för att själva beskriva effekterna av exploatering på deras marker, och vilka metoder som bör användas för att bedöma kumulativa effekter på renskötseln i miljökonsekvensbeskrivningar, avslutar Rasmus Kløcker Larsen från SEI.</p>
