This report analyses the impact of climate litigation on the oil and gas sectors in Latin America and the Caribbean, assessing its contribution to climate governance and its role in preventing and remedying human rights violations.
It also compares trends between the Global North and South to identify patterns, challenges and opportunities in the future development of climate litigation.
As the effects of climate change exacerbate inequalities and violate fundamental rights, global efforts to reduce fossil fuel production have fallen short. In this context, climate litigation plays a crucial role in challenging policies that favor the expansion of oil and gas, while also driving the development of stricter climate regulations.
Based on a literature review and analysis of data from specialized climate litigation databases, this study provides a comprehensive overview of the current state of climate litigation in the region,
identifying legal strategies, key actors, and emerging trends.
